1. Agreement to Terms

X Model Finder is a directory and search engine for OnlyFans creators. We provide a platform that connects creators with potential subscribers by organizing and displaying information about creators' profiles and content.

We do not host any OnlyFans content directly. We provide links to official OnlyFans pages and information about creators to facilitate discovery. X Model Finder is not affiliated with, endorsed by, or officially connected to OnlyFans in any way.

3. User Eligibility

You must be at least 18 years of age to access or use our Service. By using the Service, you represent and warrant that you are at least 18 years old and that your use of the Service does not violate any applicable laws or regulations.

We reserve the right to request proof of age from any user and to refuse service to anyone who cannot provide valid proof of age. Users who misrepresent their age will have their accounts terminated.

4. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of these Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password used to access your account and for any activities or actions under your account. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion.

All creator profiles, names, images, and other content relating to OnlyFans creators remain the intellectual property of their respective owners. We display this content for informational purposes only and do not claim ownership over creator content.

6. User Content

Our Service may allow you to submit, upload, publish, or otherwise make available content, including but not limited to text, photographs, videos, or other material ("User Content"). You retain any rights that you may have in your User Content.

By submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with providing and promoting the Service.

You represent and warrant that: (i) you own the User Content or have the right to use and grant us the rights in these Terms; and (ii) your User Content does not violate the privacy rights, publicity rights, intellectual property rights, or any other rights of any person or entity.

7. Creator Information and Listings

X Model Finder strives to provide accurate information about OnlyFans creators. However, we cannot guarantee the accuracy, completeness, or reliability of any creator information displayed on our Service.

Creator information may be submitted by the creators themselves, gathered from publicly available sources, or contributed by users. We make reasonable efforts to verify information but cannot independently verify all details about every creator.

If you are a creator and find inaccurate information about your profile on our Service, please contact us to request corrections or removal of your listing.

8. Prohibited Activities

You agree not to engage in any of the following activities:

• Using the Service for any illegal purpose or in violation of any laws
• Violating the intellectual property or personal rights of others
• Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service
• Taking any action that imposes an unreasonable or disproportionately large load on our infrastructure
• Uploading or transmitting viruses, malware, or any other malicious code
• Collecting or harvesting any information from the Service, including account names
• Using the Service to advertise or solicit for commercial purposes without our consent
• Impersonating another person or entity, or falsifying your affiliation with a person or entity
• Interfering with any other user's enjoyment of the Service
• Engaging in any automated use of the system, such as using scripts to send comments or messages
• Creating multiple accounts for deceptive or fraudulent purposes

9. Promotional Services

X Model Finder offers promotional services that allow creators to enhance their visibility on our platform for a fee. By purchasing any promotional services, you agree to the following terms:

• No Guarantee of Results: We do not guarantee any specific number of views, clicks, subscriptions, or revenue as a result of our promotional services. Results may vary based on numerous factors including content quality, creator profile completeness, audience demographics, market conditions, and other variables beyond our control.
• Payment and Refunds: All fees for promotional services are non-refundable. Once a promotion has been activated, we cannot provide refunds regardless of the results achieved. Payment must be made in full before promotional services are implemented.
• Content Requirements: All promotional content must comply with our general terms and conditions. We reserve the right to reject or request modifications to any content that violates our policies or that we deem inappropriate.
• Reservation of Rights: X Model Finder reserves the right to modify, suspend, or terminate any promotional service at our discretion, including for maintenance, updates, or policy changes. We may also decline to provide promotional services to any creator without providing a reason.
• Placement and Visibility: While we strive to provide optimal visibility for promoted listings, we cannot guarantee specific placement positions or that your promoted listing will appear in specific searches or browsing sessions.
• Term and Termination: Promotional services will be active for the period specified at purchase. We reserve the right to terminate promotional services without refund if you violate our terms or if your content becomes non-compliant during the promotional period.
• Limitation of Liability: In addition to the general limitation of liability in these Terms, X Model Finder specifically disclaims all liability for any loss of business, subscriptions, revenue, profits, or any other commercial damages resulting from the use of our promotional services.
• Service Modifications: We may modify the features, pricing, or availability of promotional services at any time. Changes to ongoing promotions will be communicated to affected creators.

By purchasing promotional services, you acknowledge that you have read and agree to these specific terms in addition to our general Terms and Conditions.

10. Third-Party Links and Content

Our Service may contain links to third-party websites or services that are not owned or controlled by X Model Finder. X Model Finder has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that X Model Finder shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit, including OnlyFans and any creator websites linked through our Service.

11. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or warranty, whether express, implied, or statutory. X Model Finder specifically disclaims any implied warranties of title, merchantability, fitness for a particular purpose, and non-infringement.

X Model Finder makes no warranty that: (i) the Service will meet your requirements; (ii) the Service will be uninterrupted, timely, secure, or error-free; (iii) the results that may be obtained from the use of the Service will be accurate or reliable; or (iv) the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations.

Any material downloaded or otherwise obtained through the use of the Service is done at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

12. Limitation of Liability

To the maximum extent permitted by law, X Model Finder and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all damages, losses, or causes of action exceed one hundred dollars ($100.00).

13. Indemnification

You agree to defend, indemnify, and hold harmless X Model Finder and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of: (i) your use and access of the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Service.

14. Dispute Resolution and Arbitration

You and X Model Finder agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof or the use of the Service (collectively, "Disputes") will be settled by binding arbitration, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

The arbitration will be conducted by a single, neutral arbitrator and shall take place in Wyoming, United States, in the English language. The arbitrator will apply the Federal Rules of Evidence and the Federal Rules of Civil Procedure. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver: You and X Model Finder agree that any proceedings to resolve Disputes will be conducted on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and X Model Finder each waive any right to a jury trial.

Time Limitation on Claims: You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or these Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of the state of Wyoming, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or eliminated if no such modification is possible, and the remaining provisions of these Terms will continue in full force and effect. The invalid or unenforceable provision will be replaced with a valid provision that comes closest to the intention of the original provision.

17. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

18. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
